TERMS
Netarati LLC. is the owner and operator of Hopshots.com, an online travel photo and video sharing community. Registered members of Hopshots can upload photos, videos, and travelogs to pages of towns and cities on the website. Hopshots is not a personal photo/video storage service, but a place for members to share pictures and videos.
Modifications
Netarati LLC. reserves the right to modify any part of this Agreement at any time at its sole discretion. This includes but is not limited to the image storage term, and any other Hopshots functionality. Any modification is effective immediately upon posting on this page. If any modification to this Agreement is unacceptable to you, you may immediately terminate your account. However, if you do not terminate your account, or continue to use the services following modification to this Agreement, your continued use will mean that you have accepted that modification.
Acceptable Use
Your use of the services provided by Hopshots is subject to the following agreement. Violations of this agreement may result in ermination of your account with or without notice. Hopshots recommends that members maintain their own backups of their shared content, as Hopshots cannot warrant that no loss or corruption of data shall occur. Content stored on Hopshots servers are for online photo/video sharing purposes and not for permanent or temporary archival purposes. Therefore, Hopshots is not obligated to maintain backup copies of any material submitted or posted on the website.
Prohibited Use
You may not use Hopshots.com
- In any manner that violates any law, regulation, treaty or tariff or infringes on the legal rights of any third party.
- In any manner which is defamatory, fraudulent, indecent, offensive or deceptive.
- To threaten, harass, abuse or intimidate others.
- To damage the name or reputation of Netarati LLC., its affiliates, or subsidiaries.
- To break security on any computer network, or to access an account that does not belong to you.
- In any manner that interferes with other customers' use and enjoyment of the services provided by Hopshots.com
Prohibited Content
As used herein, "content" shall mean all text, graphics, photographs, drawings, animation, audio, video, and any other material submitted, posted, viewed, transmitted, reproduced and/or distributed by any person on Hopshots.
You are prohibited from storing, posting, distributing or transmitting any unlawful content on Hopshots. Examples of unlawful content include but are not limited to direct threats of physical harm, stalking, any kind of pornography, and copyrighted, trademarked and other proprietary material used without proper authorization.
Hopshots is not responsible for content posted by its members. Hopshots does not verify or endorse any content posted by its members. If you believe that any of the content posted by Hopshots members or visitors violates your proprietary rights including copyrights, please contact us.
As a Hopshots member you are solely and fully responsible for any content posted by you. Although we review member account content on a spot check basis, we cannot establish or guarantee the legal nature of every content posted by users.
PROHIBITED CONTENT INCLUDES BUT IS NOT LIMITED TO:
- Personal photos that posess no scenic value.
- Programs containing Trojan horses, virus and/or tools to compromise the security of Hopshots and/or other sites.
- Solicitations or advertisements.
- Suggestions or encouragement of illegal activity.
- Private information about any individual such as phone numbers, addresses, social security numbers or any other private information.
- Duplicative posting or spamming. Please note that you cannot upload images foe which you have no copyright.
- Nudity, pornography, and sexual material of a lewd, lecherous or obscene nature or intent or that violates local, state, or national laws.
- Any material that violates or infringes in any way upon the proprietary rights of others including, without limitation, copyright or trademark rights.
- Any material that is threatening, abusive, harassing, slnderous, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, indecent, or otherwise objectionable; including posting private information belonging to or about other individuals.
- Content that promotes, encourages, or provides instructional information about illegal activities.
- Hate propaganda or hate mongering, swearing, or fraudulent material or activity.
Hopshots is the final arbiter of what is allowed or not allowed on the website. If a portion of the content in an account is found to be in violation of the Terms and Conditions of Use set forth in this section, the entire account may be removed.
Hopshots reserves the right to modify or remove any content in any member account at any time without prior notice if that account violates the Terms of Use set forth in this section.
Membership
Membership is available to anyone who provides all required information including name and an accurate and legitimate email address. The member will then be able to upload images to the website.
Hopshots may terminate any membership and delete any and all information, communications, postings, albums and images at any time, without notice, for conduct violating this Agreement or other policies or guidelines set forth by Netarati LLC.
Limitation of Liability
Under no circumstances, including but not limited to negligence, shall Netarati LLC. be liable for any special or consequential damages arising out of your use or inability to use Hopshots, any Hopshots content, services, products and/or any related software. By submitting your photos to Hopshots you represent that the photos, titles and descriptions comply with the Terms and Conditions of Use set forth in this section. Netarati LLC will not be lieable for any claim, lawsuit or other proceeding brought by a third party based on content you post on the site.
Copyright and Trademark
It is the obligation of the individual members to ensure that the posting of their photos violates no copyright. Members are solely responsible for the content of their photo albums. If you feel a member is violating your copyright, please contact us.
Netarati LLC. claims no ownership rights to the content you place on the website. We will not use members' images for marketing purposes or any other purposes without first obtaining that member's express permission.
Hopshots is a registered trademark of Netarati LLC. All images, text, and any other content on the site are protected by copyright, trademark, patent or other proprietary rights and laws. All content - other than those uploaded by members - is copyrighted by Netarati LLC.
